Top That respects the intellectual property rights of others and expects members to do the same. Members may only upload content they created or have permission to use. This page explains how rights holders can report infringement on Top That, operated by challenged online llc, and how we handle those reports under the Digital Millennium Copyright Act (17 U.S.C. § 512).

Please put "DMCA takedown" in the subject line so your notice is routed quickly.

Filing a takedown notice

If you believe content on Top That infringes your copyright, send a notice to the agent above including:

Identification of the copyrighted work you claim is infringed.
Identification of the infringing material and where it appears on Top That (a challenge link like topthat.app/challenge/… is ideal), with enough detail for us to find it.
Your name, mailing address, telephone number, and email address.
A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Your physical or electronic signature.

We remove or disable access to material identified in valid notices expeditiously, and we notify the member who posted it.

Counter-notice

If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notice to the same agent including: identification of the removed material and where it appeared, your name, address, and telephone number, a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification, a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any judicial district in which challenged online llc may be found) and that you will accept service of process from the person who filed the original notice, and your physical or electronic signature.

Unless the original complainant informs us they have filed a court action, removed material may be restored 10 to 14 business days after we receive a valid counter-notice.

Repeat infringers

Accounts that receive repeated valid infringement notices are terminated. We may also limit features or remove content on fewer notices where circumstances warrant.

Misrepresentation

Knowingly misrepresenting that material is infringing, or that it was removed by mistake, can make you liable for damages under 17 U.S.C. § 512(f). Please make sure your notice is accurate.

In-app reporting

Members can also report a battle from inside the app (Report > privacy or intellectual property). In-app reports are reviewed the same way, but a formal DMCA notice to the agent above is the fastest path for rights holders.
